「授業目的公衆送信補償金制度」について / Compensation System for Public Transmission for Educational Purposes
新型コロナウイルス感染症の拡大防止、教育機関におけるオンライン遠隔授業等での著作物利用のニーズに応えるため、2020年4月28日（火）より、著作権法35条に関する「授業目的公衆送信補償金制度」が前倒しで施行されることとなりました。これによって、「著作権者の利益を不当に害しない」限り、著作物を著作権者の許諾を得ることなくオンライン授業にて無償で（2021年4月からは有償で）公衆送信（ネットで配信すること）できるようになりました。
一部では「教科書、ネット授業で自由に」などと誤解を受けるような報道がなされていますが、教科書、問題集等、個々の学習者が購入することを想定して販売されているものは、著作権者の利益を不当に害することになるので、自由に利用できる訳ではありません。教科書のコピー（紙）を教室で配布する場合と同様に、著作権者の許諾が必要となります。小社で発行しております教科書等も、受講者が購入することを想定しており、授業等の教育目的であっても、無断で複製・公衆送信で利用することは著作権法違反となります。
しかし、このたびの緊急事態で、授業開始までに書籍を購入することが困難となりうる事情を鑑みまして、該当書籍を教科書にご指定いただいている講義の場合で、かつ、受講者が教科書を購入できない期間に限り、分量・送信方法の制限などの一定条件のもと、小社書籍の一部をオンライン講義で利用することを許諾させていただきます。
また、すでに受講者に書籍をご購入いただいております講義において、資料として書籍やその付録のデータ（文章、文字データ、画像、音声、動画）をオンラインでご利用になりたい場合については、一定条件のもと利用を許諾させていただきます。
いずれの場合も、受講者に教科書等をご購入いただくことが前提となっており、そうでない場合は、恐れ入りますが利用を許諾できませんことをご了承願います。

In order to prevent the spread of COVID-19 infection and to meet the needs of educational institutions for the use of copyrighted works in online distance learning, etc., the “Compensation System for Public Transmission for Educational Purposes” under Article 35 of the Copyright Act came into effect ahead of schedule on Tuesday, April 28, 2020. This allows copyrighted works to be publicly transmitted (distribution over the Internet) free of charge (fee required from April, 2021) in online classes without the permission of the copyright holder, as long as it does not “unreasonably harm the interests of the copyright holder.”
However, textbooks, workbooks, and other materials that are sold with the assumption that individual learners will purchase them will not be freely available since it will unfairly harm the interests of the copyright holder. As with photocopying and distributing copies of the textbooks in the classroom, permission from the copyright holder is required. Textbooks and other materials published by Kinseido are sold with the assumption that students will purchase them. Thus, it is a violation of the Copyright Act to use them for reproduction or public transmission without permission, even for educational purposes.
However, in light of the emergency situation that may make it difficult for students to purchase the textbooks before the start of the class, we will allow teachers to use some of our materials for online lectures under certain conditions, such as restrictions on volume and transmission methods. Also, the textbook you specify has to be the assigned book for the class, and materials we provide can only be used during the period when students are unable to purchase the textbooks.
If you have already ordered our titles and wish to use it or its accompanying materials (text data, images, audio and video) for online lectures, you will be granted permission to do so under certain conditions.
In either case, students must purchase the textbooks. Otherwise, please understand that we will not be able to grant permission to use the digital data.
